{"id":14399,"date":"2023-07-10T22:53:15","date_gmt":"2023-07-10T22:53:15","guid":{"rendered":"https:\/\/careerinlaw.net\/uk\/?p=14399"},"modified":"2023-11-23T09:46:20","modified_gmt":"2023-11-23T14:46:20","slug":"case-summary-prebble-v-television-new-zealand-ltd-1995-1-ac-321","status":"publish","type":"post","link":"https:\/\/careerinlaw.net\/uk\/case-summary-prebble-v-television-new-zealand-ltd-1995-1-ac-321","title":{"rendered":"Case Summary: Prebble v Television New Zealand Ltd [1995] 1 AC 321"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-legal-principles-and-key-points\"><strong>Legal Principles and Key Points<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the case of Prebble v Television New Zealand Ltd [1995] 1 AC 321, any court of place outside of Parliamentary walls cannot call into question or doubt the freedom of speech and debates or proceedings that take place within Parliament.<\/li>\n\n\n\n<li>It was held that the above would be seen as an impediment to Parliamentary privilege.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Facts of the Case<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C was an MP and D was a New Zealand based TV corporation.<\/li>\n\n\n\n<li>D asserted in his allegation against C that C is corrupt on television.<\/li>\n\n\n\n<li>C brought a case of libel against D and wished to clear his name from the words presented by D. C wished to use evidence from parliamentary proceedings to do so.<\/li>\n\n\n\n<li>C wished for the action to be struck down as it was seen that such an investigation into parliamentary proceedings would be deemed as an infringement on parliamentary privilege under Article 9 of the Bill of Rights 1688.<\/li>\n\n\n\n<li>Article 9 of the Bill of Rights 1688 provided the following provision: \u201cThe freedom of speech and debates or proceedings in Parliament ought not to be impeached or questioned in any court or place out of Parliament.\u201d<\/li>\n\n\n\n<li>C stayed his action, awaiting a waiver from Parliament to allow the investigatory process. This, however, did not come to fruition.<\/li>\n\n\n\n<li>C appealed to the Privy Council against the stay.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Issues<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Could the exercise of parliamentary privilege stay proceedings under Article 9?<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Held by the Privy Council<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It was held that parliamentary privilege could be exercised to stay the claim under Article 0 of the Bill of Rights.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lord Browne-Wilkinson<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The appeal against the stay was allowed here because D\u2019s evidence would not be taken from parliamentary proceedings.<\/li>\n\n\n\n<li>It was found that Article 9\u2019s intention is to protect the overall integrity of Parliament. This means that a decision by an individual does not have the capacity to override Parliamentary privilege. As such, the stay on the proceedings was rightfully justified.<\/li>\n\n\n\n<li>\u201cThe burden of the libel relates to acts done by members of the government out of the House to which questions of
