C received money from another party in exchange for a bramblefinch hen.<\/li>\n\n\n\n<li>At first instance, C was prosecuted by D, on behalf of the RSPCA, for unlawfully offering for sale a wild bird from the British Isles. D won at first instance under s 6 and sch 4 of the Protection of Birds Act 1954.<\/li>\n\n\n\n<li>C appealed arguing the bramblefinch hen arrived wearing a removable closed ring and that the advertisement was not an offer for sale.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Issues<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whether there was an offer for sale.<\/li>\n\n\n\n<li>Whether there was an invitation to treat.<\/li>\n\n\n\n<li>Whether the bramblefinch hen was &#8220;close ringed&#8221; even though it was possible to remove the ring.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Held by High Court<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Appeal allowed &#8211; the appellant possessed for sale this hen but there was no offer and C is not legally bound by those terms because it\u2019s only an invitation to treat.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ashworth J<\/strong><\/h2>\n\n\n\n<p>Offer for sale<\/p><div id=\"caree-3199398926\" class=\"caree-within-the-content caree-entity-placement\" style=\"margin-left: auto;margin-right: auto;text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png\" alt=\"\"  srcset=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png 448w, https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1-300x250.png 300w\" sizes=\"(max-width: 448px) 100vw, 448px\" width=\"448\" height=\"373\"  style=\"display: inline-block;\" \/><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The magazine and the heading does not explicitly indicate that the list of birds are on offer for sale.<\/li>\n\n\n\n<li>There was a completed sale because a bramblefinch bird was sent to the other party in exchange for money however at first instance the C should not have been prosecuted for the published magazine advertisement.<\/li>\n<\/ul>\n\n\n\n<p>Definition of close-ringed<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The judge defined close-ringed as a complete ring that can&#8217;t easily be broken or tarnished. The bramblefinch hen was not determined to be a close ringed bird.<\/li>\n\n\n\n<li>\u201cI would say if one was looking for a definition of the phrase \u201cclose-ringed\u201d it means ringed by a complete ring, which is not capable of being forced apart or broken except, of course, with the intention of damaging it.\u201d [5]<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lord Parker C.J.<\/strong><\/h2>\n\n\n\n<p>Invitation to treat or offer<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>This case heavily references to Fisher v. Bell [1961] 1 Q.B. 394 where the stocking of flick knives was not offered for sale despite its visibility from a shop window.
