{"id":14277,"date":"2023-07-10T00:51:35","date_gmt":"2023-07-10T00:51:35","guid":{"rendered":"https:\/\/careerinlaw.net\/uk\/?p=14277"},"modified":"2023-11-23T09:45:53","modified_gmt":"2023-11-23T14:45:53","slug":"case-summary-lloyds-bank-v-rosset-1988-3-all-er-915","status":"publish","type":"post","link":"https:\/\/careerinlaw.net\/uk\/case-summary-lloyds-bank-v-rosset-1988-3-all-er-915","title":{"rendered":"Case Summary: Lloyds Bank v Rosset [1988] 3 All ER 915"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-legal-principles-and-key-points\"><strong>Legal Principles and Key Points:<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the case of Lloyds Bank v Rosset [1988] 3 All ER 915, the relevant date to determine actual occupation was affirmed \u2013 being at the date of transfer or creation of estate, rather than its registration.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Facts of Lloyds Bank v Rosset [1988] 3 All ER 915<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>D\u2019s husband bought a home for himself and his wife to reside in<\/li>\n\n\n\n<li>He took out a mortgage with the C bank<\/li>\n\n\n\n<li>The common intention of the parties was that the home\u2019s renovation would be a joint venture, and the D wife had a beneficial interest in the property under a constructive trust<\/li>\n\n\n\n<li>D spent almost every day helping the builders, she was unaware that her husband had successfully applied for an overdraft for the purchasing and repairs<\/li>\n\n\n\n<li>This meant D did not contribute to either the purchasing of the home, nor the repairs<\/li>\n\n\n\n<li>The husband made no payments to C, the payment defaulted, and they sought possession of the property and an order for its sale<\/li>\n\n\n\n<li>D argued this could not happen due to her overriding interest in the property under s70 of the Land Registration Act 1925<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Issues in Lloyds Bank v Rosset [1988] 3 All ER 915<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Did the D, who did not make monetary contributions to the home, have an overriding interest?<\/li>\n\n\n\n<li>Was she in actual occupation at the time the mortgage was taken out?<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Held by the Court of Appeal<\/strong><\/h2>\n\n\n\n<p>D had an overriding proprietary interest in the property, she held a beneficial interest in the home and was found to be in actual occupation at the time of the mortgage agreement.<\/p><div id=\"caree-840040489\" class=\"caree-within-the-content caree-entity-placement\" style=\"margin-left: auto;margin-right: auto;text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png\" alt=\"\"  srcset=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png 448w, https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1-300x250.png 300w\" sizes=\"(max-width: 448px) 100vw, 448px\" width=\"448\" height=\"373\"  style=\"display: inline-block;\" \/><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lord Justice Nicholls<\/strong><\/h2>\n\n\n\n<p>Recognised the difficulty in understanding what to make of \u201cthe interval between execution of a transfer or mortgage and registration\u201d [922]<\/p>\n\n\n\n<p>\u201cIf a person is intending to move into a house but has not yet done so, he would not normally be regarded as having gone into occupation. That is the normal position with a house which is fit for living in. But that does not provide the answer in the present case, where the house was semi-derelict.\u201d [925]<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lord Justice Mustill dissenting<\/strong><\/h2>\n\n\n\n<p>Mustill LJ did not believe D to have an overriding interest, going as far as to say:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cEven if the statute had referred to no more than &#8216;occupation&#8217;, and even if the various clues to the meaning of para (g) to which I have previously referred had not been available, I would still have held that the wife was preparing the home for occupation, but was not in occupation on the relevant date and with these further considerations added, I conclude with less hesitation (although acknowledging the difficulty of the issue) that the wife did not have an overriding interest within the meaning of s 70(1)\u201d [942]<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Editorial comment<\/strong><\/h2>\n\n\n\n<p>This only concerned the issue of actual occupation.
