This will count as mental distress.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Facts of Jarvis v Swans Tours Ltd [1973] QB 233<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C (Jarvis) booked a Christmas holiday with the Ds, Swans Tours<\/li>\n\n\n\n<li>He had booked it on the reliance of the Ds\u2019 brochure naming a \u2018house party centre\u2019<\/li>\n\n\n\n<li>For the booking, C paid \u00a363.45<\/li>\n\n\n\n<li>The holiday was a disappointment for the C who then claimed damages which included damages for the inconvenience and loss of benefit<\/li>\n\n\n\n<li>The County Court awarded the C half of what he claimed, finding that the second week was inferior to the first<\/li>\n\n\n\n<li>C appealed against the amount of damages, believing the award to be inadequate<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Issues in Jarvis v Swans Tours Ltd [1973] QB 233<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Should one be awarded damages for disappointment of enjoyment he was promised?<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Held by the Court of Appeal<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Appeal allowed. The C was awarded damages based on his disappointment with the overall holiday.<\/p><div id=\"caree-1322434707\" class=\"caree-within-the-content caree-entity-placement\" style=\"margin-left: auto;margin-right: auto;text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png\" alt=\"\"  srcset=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png 448w, https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1-300x250.png 300w\" sizes=\"(max-width: 448px) 100vw, 448px\" width=\"448\" height=\"373\"  style=\"display: inline-block;\" \/><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lord Denning M.R.<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Citing <em>Hamlin [1856]<\/em> and <em>Hobbs [1875]<\/em>, Lord Denning noted the previous position of the law in respect of mental distress [237]:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cIt has often been said that on a breach of contract damages cannot be given for mental distress.\u201d<\/li>\n\n\n\n<li>\u201cThe courts in those days only allowed the plaintiff to recover damages if he suffered physical inconvenience, such as having to walk five miles home, as in Hobbs&#8217; case; or to live in an over-crowded house \u2026 <em>Bullock [1950]<\/em>\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">However, Lord Denning believed those limitations to be outdated, and mental distress could be recovered in contract cases, \u201cjust as damages for shock can be recovered in tort.\u201d [238]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He went further stating [238]:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cIf the contracting party breaks his contract, damages can be given for the disappointment, the distress, the upset and frustration caused by the breach. I know that it is difficult to assess in terms of money, but it is no more difficult than the assessment which the courts have to make every day in personal injury cases for loss of amenities.\u201d<\/li>\n\n\n\n<li>Applying this to Mr Jarvis\u2019 case, Lord Denning believed the C should be compensated for the holiday he was looking forward to since booking in advance<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Loss of enjoyment should be compensated, and Lord Denning used Lord Justice Edmund Davies\u2019 point to illustrate such [238]:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201ca man who has taken a ticket for Glyndbourne. It is the only night on which he can get there. He hires a car to take him. The car does not turn up. His damages are not limited to the mere cost of the ticket.
