{"id":14113,"date":"2023-07-08T16:27:20","date_gmt":"2023-07-08T16:27:20","guid":{"rendered":"https:\/\/careerinlaw.net\/uk\/?p=14113"},"modified":"2023-11-23T09:45:05","modified_gmt":"2023-11-23T14:45:05","slug":"case-summary-hyde-v-wrench-1840-ewhc-ch-j90","status":"publish","type":"post","link":"https:\/\/careerinlaw.net\/uk\/case-summary-hyde-v-wrench-1840-ewhc-ch-j90","title":{"rendered":"Case Summary: Hyde v Wrench 1840 EWHC Ch j90"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-legal-principles-and-key-points\"><strong>Legal Principles and Key Points<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the case of Hyde v Wrench 1840 EWHC Ch j90, the principle of a counteroffer destroys the original offer was laid out.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Facts of the Case<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>D offered in writing on 6<sup>th<\/sup> June to sell C his farm at a price of \u00a31000 to which C counter offered on the 27<sup>th of<\/sup> June for \u00a3950 although D refused this.<\/li>\n\n\n\n<li>C then offered \u00a31000 but D refused and as a result, C sued for a breach of contract.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Issues in Hyde v Wrench 1840 EWHC Ch j90<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Did the counteroffer destroy the original offer?<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Held by High Court<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Claim failed.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lord Langdale<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Here, it was held that as there was no original contract for the \u00a31000 offer, it was successfully destroyed upon the counteroffer of \u00a3950.<\/li>\n\n\n\n<li>The judge found that if the original offer had been unconditionally accepted, there would have been a binding contract however instead of this, C made an offer of his own thereby rejecting D\u2019s offer to sell the farm at \u00a31000.<\/li>\n\n\n\n<li>\u201cUnder the circumstances stated in this bill, I think there exists no valid binding contract between the parties for the purchase of the property. The Defendant offered to sell it for \u00a31000, and if that had been at once unconditionally accepted, there would undoubtedly have been a perfect binding contract; instead of that, the Plaintiff made an offer of his own, to purchase the property for \u00a3950, and he thereby rejected the offer previously made by the Defendant. I think that it was not afterwards competent for him to revive the proposal of the Defendant, by tendering an acceptance of it; and that, therefore, there exists no obligation of any sort between the
