{"id":13904,"date":"2023-07-06T01:20:34","date_gmt":"2023-07-06T01:20:34","guid":{"rendered":"https:\/\/careerinlaw.net\/uk\/?p=13904"},"modified":"2023-11-23T09:44:16","modified_gmt":"2023-11-23T14:44:16","slug":"case-summary-foakes-v-beer-1884-app-cas-605","status":"publish","type":"post","link":"https:\/\/careerinlaw.net\/uk\/case-summary-foakes-v-beer-1884-app-cas-605","title":{"rendered":"Case Summary: Foakes v Beer 1884 app cas 605"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-legal-principles-and-key-points\"><strong>Legal Principles and Key Points<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the case of Foakes v Beer 1884 app cas 605, it was held that a promise to accept less than someone is entitled to under a pre-existing contract is not binding for want of consideration.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Facts of the Case<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C gained a court judgment entitling her to a sum of money from D (plus interest)<\/li>\n\n\n\n<li>C agree to let go the interest and any proceedings claim to the interest of C paid \u00a3500 immediately and \u00a3150 on two occasions each year till the whole sum was paid.<\/li>\n\n\n\n<li>Once the total sum was paid, C brought an action to claim the interest.<\/li>\n\n\n\n<li>D then argued that she was bound by her previous promise not to claim the interest. &nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Issues in Foakes v Beer 1884 app cas 605<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Was c entitled to the interest?<\/li>\n\n\n\n<li>Was there calid consideration to bind C to the promise.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Held by House of Lords<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C entitled to the interest.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lord Blackburn<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Here a lesser sum cannot be satisfaction of a greater sum.<\/li>\n\n\n\n<li>Immediate payment of a lesser sum can be of greater value than insisting on full payment, even when the debtor is solvent.<\/li>\n\n\n\n<li>\u201cIn relation to a judgment debt payable immediately, and on which the creditor is entitled to have execution, is the payment by the debtor of a part a sufficient consideration to support a parol agreement by the judgment creditor not to take any proceedings whatever on the judgment for the residue? In my opinion it is not; and I think, therefore, that the judgment of the Court of Appeal should be affirmed\u201d.
