In total, this added up to 250 dozen cambric handkerchiefs prior to discovering these were fraudulent transactions.<\/li>\n\n\n\n<li>D, the company name which the third party used to make the transactions, attempted to recover some handkerchiefs from C in this appeal.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Issues<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whether the contract was legitimate.<\/li>\n\n\n\n<li>Whether there was a common mistake.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Held by House of Lords<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Appeal dismissed \u2013 contract was void and there was an operable mistake.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lord Cairns<\/strong><\/h2>\n\n\n\n<p>Mistake<\/p><div id=\"caree-4191103838\" class=\"caree-within-the-content caree-entity-placement\" style=\"margin-left: auto;margin-right: auto;text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png\" alt=\"\"  srcset=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png 448w, https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1-300x250.png 300w\" sizes=\"(max-width: 448px) 100vw, 448px\" width=\"448\" height=\"373\"  style=\"display: inline-block;\" \/><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>C is innocent and had to return the handkerchiefs due to the acts of the third party.<\/li>\n\n\n\n<li>\u201cHow is it possible to imagine that in that state of things any contract could have arisen between the Respondents and Blenkarn, the dishonest man? Of him, they knew nothing, and of him they never thought. With him they never intended to deal. Their minds never for an instant of time rested upon him, and as between him and them there was no consensus of mind which could lead to any agreement or any contract whatever.\u201d<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Lord Hatherley<\/strong><\/h2>\n\n\n\n<p>Did a contract exist between the parties?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The judge relied on Hardman v Booth [1863] 1 H &amp; C 803 to similarly hold that there is no real contract in place.<\/li>\n\n\n\n<li>\u201cNo contract was ever intended between the vendors of the goods and the person who had professed to purchase the goods as the agent of that firm; and the consequence was that there was no contract at all.
