{"id":13499,"date":"2023-06-29T01:14:24","date_gmt":"2023-06-29T01:14:24","guid":{"rendered":"https:\/\/careerinlaw.net\/uk\/?p=13499"},"modified":"2023-11-23T09:39:00","modified_gmt":"2023-11-23T14:39:00","slug":"case-summary-case-of-proclamations-1611-77-er-1352-12-co-rep-74","status":"publish","type":"post","link":"https:\/\/careerinlaw.net\/uk\/case-summary-case-of-proclamations-1611-77-er-1352-12-co-rep-74","title":{"rendered":"Case Summary: Case of Proclamations (1611) 77 ER 1352, 12 Co rep 74"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-legal-principles-and-key-points\"><strong>Legal Principles and Key Points<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the case of Case of Proclamations (1611) 77 ER 1352, 12 Co rep 74, it was found that common law defines the degree of royal prerogative.<\/li>\n\n\n\n<li>It was also held that the Crown is not entitled to legally utilise its prerogative powers outside the degree it is defined.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Facts of the Case<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>D, King James I, sought to prevent new buildings being built in London as well as the making of starch of wheat in the absence of Parliamentary consent.<\/li>\n\n\n\n<li>C, the House of Commons, described D\u2019s actions as grievances and contrary to the law.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Issues<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Was D able to exercise his royal prerogative to alter existing laws in the absence of Parliamentary consent?<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Held by the Court of King\u2019s Bench<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Court held that it was unlawful for D to exercise his royal prerogative to alter existing laws without gaining Parliament\u2019s permission to do so because the royal prerogative did not provide D with the power to create new offences.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Sir Edward Coke, Chief Justice of the Common<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The judge emphasised D\u2019s lack of capability to alter laws without going through the Parliamentary procedure. Where the law already permits an action, D was not able to convert such action into an unlawful one.<\/li>\n\n\n\n<li>\u201cThe King cannot change any part of the common law, nor create any offence by his proclamation, which was not an offence before, without Parliament.\u201d [75]<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Editor\u2019s Notes<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>This was an importance and defining moment in common law as the outcome clearly defined the principle of separation of the powers in Britain\u2019s Constitution.
