{"id":13428,"date":"2023-06-28T19:14:06","date_gmt":"2023-06-28T19:14:06","guid":{"rendered":"https:\/\/careerinlaw.net\/uk\/?p=13428"},"modified":"2023-11-23T09:38:31","modified_gmt":"2023-11-23T14:38:31","slug":"case-summary-case-c-48-93-factortame-no-3-brasserie-du-pecheur-1996-ecr-i-1029","status":"publish","type":"post","link":"https:\/\/careerinlaw.net\/uk\/case-summary-case-c-48-93-factortame-no-3-brasserie-du-pecheur-1996-ecr-i-1029","title":{"rendered":"Case Summary: Case C-48\/93 Factortame No 3 Brasserie du P\u00eacheur [1996] ECR I-1029"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-legal-principles-and-key-points\"><strong>Legal Principles and Key Points<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the case of Case C-48\/93 Factortame No 3 Brasserie du P\u00eacheur [1996] ECR I-1029, it was established that, upon considering the liability of the State, the Francovich liability shall only arise in situations whereby there was a sufficiently serious breach due to the grave disregard of limits on State discretion.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Facts of Case C-48\/93 Factortame No 3 Brasserie du P\u00eacheur [1996] ECR I-1029<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>French company Brasserie du P\u00eacheur sought damages against Member State Germany for a loss they suffered from a restriction on beer by Germany (found to be incompatible with Article 30)<\/li>\n\n\n\n<li>UL company Factortame, with others, sought damages for the loss of registration of fishing boats by the United Kingdom (found to be incompatible Article 52)<\/li>\n\n\n\n<li>In connection with both cases, the Cs were bringing actions against Member States for breach of EU law;<\/li>\n\n\n\n<li>The relevant courts sought a preliminary ruling by the European Court of Justice as to the conditions where a Member State may incur the liability for reparation to individuals due to a breach by the State<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Issues in Case C-48\/93 Factortame No 3 Brasserie du P\u00eacheur [1996] ECR I-1029<\/strong><\/h2>\n\n\n\n<p>What were the conditions under which a Member State may incur liability for damages caused to individuals by breach(es) of Community law, by that State?<\/p><div id=\"caree-1877342062\" class=\"caree-within-the-content caree-entity-placement\" style=\"margin-left: auto;margin-right: auto;text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png\" alt=\"\"  srcset=\"https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1.png 448w, https:\/\/careerinlaw.net\/uk\/wp-content\/uploads\/sites\/3\/2023\/10\/MRF-169650-in-article-336x280-1-300x250.png 300w\" sizes=\"(max-width: 448px) 100vw, 448px\" width=\"448\" height=\"373\"  style=\"display: inline-block;\" \/><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Held by the European Court of Justice<\/strong><\/h2>\n\n\n\n<p>The three conditions laid out by the CJEU, where a right to reparation is conferred [51]:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\">\n<li>The law infringed was intended to confer rights on individuals;<\/li>\n\n\n\n<li>The breach was sufficiently serious;<\/li>\n\n\n\n<li>There was a direct causal link between: the breach of the obligation resting with the State, and the damage sustained by the individual(s)<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Findings of the Court<\/strong><\/h2>\n\n\n\n<p>To decide whether the Member State committed a sufficiently serious breach of Community law, the CJEU established \u201cthe decisive test\u201d for such occurs where the State \u201cmanifestly and gravely disregarded the limits on its discretion\u201d [4]<\/p>\n\n\n\n<p>Having laid down the conditions required, the court justified their existence as<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cthose conditions satisfy the requirements of the full effectiveness of the rules of Community law and of the effective protection of the rights which those rules confer.\u201d [52]<\/li>\n<\/ul>\n\n\n\n<p>Further, the conditions set out were in line with existing community law, providing certainty:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cthose conditions correspond in substance to those defined by the Court in relation to Article 215 in its case-law on liability of the Community for damage caused to individuals by unlawful legislative measures adopted by its institutions.\u201d [53]<\/li>\n<\/ul>\n\n\n\n<p>Persistence of breach after judgments, preliminary rulings, and settled case law can clearly show a breach being of sufficient severity [57]. But the CJEU believed the conditions set out \u201cwill be helpful to indicate a number of circumstances which the national courts might take into account.\u201d
